Eligibility for Refund: If you are unsatisfied with our Service, you may request a refund within 24 hours of your purchase. The refund will be issued for the amount paid, excluding any non-refundable fees charged by the payment gateway and any applicable setup fees.

Conditions for Refund: Refunds will not be granted under the following conditions:

• Violation of Terms: If you have violated any part of these Terms.

• Abuse or Illegal Activities: Involvement in activities such as outgoing DDoS attacks, hosting illegal content, or participating in attacks on our network.

• Excessive Usage: If your data traffic exceeds 5GB within the 24-hour period.

• Excessive Refunds: If you have previously requested and received refunds more than twice within a 90-day period.

Process for Refund: To request a refund, contact our customer support team with your account details and reason for the request. We will process eligible refunds within 3 business days.

Section 3 - Acceptable Use Policy

You agree not to use the Service for any of the following prohibited activities:

Illegal Activities

• Engaging in or promoting illegal activities, including but not limited to fraud, money laundering, or any activity that violates local, state, national, or international laws.

Harassment and Harm

• Transmitting or posting content that is defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable.

Infringement of Rights

• Uploading or sharing content that infringes on any intellectual property rights, including copyrights, trademarks, patents, or trade secrets.

Security Violations

• Harmful Code: Distributing viruses, worms, malware, or any other harmful code.

• Unauthorized Access: Attempting to gain unauthorized access to our systems or networks.

• Interference: Interfering with the proper functioning of the Service, including deliberate attempts to overload a system.

Network Abuse

• DDoS Attacks: Initiating or participating in distributed denial-of-service attacks.

• Port Scanning: Performing unauthorized port scans or probing of other network devices.

• Open Proxies/Relays: Operating open proxies or email relays.

Spamming and Unsolicited Messages

• Email Spam: Sending unsolicited bulk emails or messages (spam).

• Message Bombing: Flooding individuals or newsgroups with large volumes of unsolicited messages.

Prohibited Content

• Child Exploitation: Any content that exploits or harms minors, including child sexual abuse material.

• Violent Extremism: Content that promotes terrorism, violence, or extremist views.

• Hate Speech: Content that incites hatred or discrimination against individuals or groups.

Cryptocurrency Activities

• Mining: Engaging in cryptocurrency mining activities.

• Decentralized Services: Operating decentralized storage or computing services associated with cryptocurrencies.

Privacy Violations

• Data Harvesting: Collecting or harvesting personal information without consent.

• Phishing: Attempting to deceive or defraud others into providing sensitive information.

Resource Abuse

• Excessive Usage: Using excessive amounts of system resources that disrupt normal operations.

• Automated Processes: Running automated processes that negatively impact the Service.

Misrepresentation and Fraud

• Impersonation: Impersonating any person or entity or falsely stating your affiliation.

• Fraudulent Activities: Engaging in deceptive activities intended to defraud others.

Abuse Towards Staff

• Harassment: Using abusive or threatening language towards our employees.

• Support Channel Abuse: Spamming our support channels or opening multiple tickets for the same issue.

Other Prohibited Activities: Any other activities that we determine, at our sole discretion, to be harmful, offensive, or inappropriate.

Section 4 - Service Suspension and Termination

Right to Suspend or Terminate: We reserve the right to suspend or terminate your access to the Service immediately and without notice if we believe you have violated these Terms or if your use of the Service may harm our network, other customers, or third parties.

Effect of Termination: Upon termination, your right to use the Service will cease immediately. Any data associated with your account may be deleted.

No Liability: We shall not be liable to you or any third party for any suspension or termination of your access to the Service.

Section 5 - Payment Terms

Timely Payment: You agree to pay all fees and charges associated with your account on time. Failure to do so may result in suspension or termination of the Service.

No Withholding: Payments must be made without withholding, counterclaim, or set-off.

Section 6 - Disclaimer of Warranties

Service Provided "As Is": The Service is provided on an "as is" and "as available" basis without warranties of any kind.

No Warranties: We make no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Section 7 - Limitation of Liability

Exclusion of Damages: In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

Maximum Liability: Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount paid by you to us in the three (3) months prior to the claim.

You agree to indemnify, defend, and hold harmless YxVM, its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service or violation of these Terms.

Section 9 - Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.

Severability: If any provision of these Terms is held invalid, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Assignment: You may not assign these Terms or any rights or obligations herein without our prior written consent.

Force Majeure: We shall not be liable for delays or failures in performance resulting from acts beyond our reasonable control, including but not limited to natural disasters, war, terrorism, or governmental actions.

By using our Service, you acknowledge that you have read, understood, and agreed to these Terms of Service.
